Terms of Use

1. Eligibility

You must be at least 18 years of age to use PivChart. By creating an account, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into this agreement
• All information you provide during registration is accurate and truthful
• You will maintain the accuracy of your account information

2. Nature of the Service

PivChart is a technical analysis tool that provides algorithmic pattern recognition on publicly available market data. The Platform is provided strictly for educational and informational purposes only.

3. Account Registration and Security

To access certain features you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Verify your email address as required by the Platform
• Maintain the confidentiality of your password and not share it with any third party
• Notify us immediately of any unauthorised access to your account at support@pivchart.com
• Accept responsibility for all activities that occur under your account

PivChart reserves the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Permitted Use

You may use PivChart solely for lawful personal, non-commercial purposes. You are permitted to:

• Scan stocks and view technical analysis outputs for your own research
• Add stocks to your watchlist
• Post technical observations in the community chat
• View your historical scan records

5. Prohibited Conduct

You expressly agree NOT to:

1. Use the Platform to provide, solicit, or distribute investment advice, tips, price targets, or trading recommendations to others
2. Post content that constitutes market manipulation, pump-and-dump schemes, or any activity that may violate the SEBI Act 1992, SEBI (Prohibition of Insider Trading) Regulations 2015, or SEBI (Prohibition of Fraudulent and Unfair Trade Practices) Regulations 2003
3. Share insider information, non-public price-sensitive information, or material non-public information about any security
4. Scrape, crawl, or systematically extract data from the Platform
5. Use automated bots, scripts, or tools to access the Platform
6. Attempt to reverse-engineer, decompile, or circumvent the Platform's security measures
7. Impersonate any person or entity or misrepresent your affiliation
8. Post abusive, defamatory, obscene, or harassing content in the community chat
9. Share obscene material, which is an offence under Section 67 of the IT Act 2000
10. Use the Platform for any commercial purpose without our prior written consent
11. Create multiple accounts to circumvent scan limits or bans
12. Use another user's account without their permission

6. Community Chat — User-Generated Content

PivChart provides a community chat feature. By posting content, you:

• Represent that your content is your original technical observation and does not constitute investment advice
• Grant PivChart a non-exclusive, royalty-free licence to display, moderate, and remove your content
• Accept sole responsibility for your content and its consequences
• Acknowledge that PivChart moderates content using automated filters and manual review

PivChart reserves the right to remove any content at its sole discretion without prior notice and to suspend or permanently ban users who violate community standards.

7. Intellectual Property

All content on PivChart — including but not limited to the platform design, algorithms, code, pattern detection logic, UI elements, and branding — is the exclusive property of PivChart and is protected under applicable intellectual property laws including the Copyright Act 1957 and the IT Act 2000.

You may not copy, reproduce, distribute, modify, or create derivative works from any PivChart content without express written permission.

8. Market Data

Market data displayed on PivChart is sourced from third-party market data providers and is provided with a 15-minute delay as per NSE/BSE exchange regulations. This data is made available "as-is" for informational purposes. PivChart makes no warranty regarding the accuracy, completeness, or timeliness of market data.

9. Service Availability and Modifications

PivChart is provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted or error-free service. We reserve the right to:

• Modify, suspend, or discontinue any part of the Platform at any time
• Change plan limits, features, or pricing with reasonable notice
• Update these Terms at any time; continued use constitutes acceptance

10. Limitation of Liability

To the maximum extent permitted by applicable Indian law, PivChart and its operators shall not be liable for:

• Any trading losses, financial losses, or investment losses arising from use of the Platform
• Any indirect, incidental, consequential, or punitive damages
• Loss of data, business opportunity, or reputation
• Errors or inaccuracies in market data or pattern detection
• Actions of third-party technology and infrastructure providers engaged by PivChart

In no event shall PivChart's total liability to you exceed the amount, if any, paid by you to PivChart in the preceding 12 months.

11. Indemnification

You agree to indemnify and hold harmless PivChart, its operators, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your violation of these Terms
• Your use of the Platform
• Content you post on the Platform
• Your violation of any applicable law or regulation

12. Termination

We reserve the right to suspend or terminate your account with immediate effect if we reasonably believe you have:

• Violated these Terms or any applicable law
• Provided false registration information
• Engaged in market manipulation or provided investment tips
• Harassed other users
• Attempted to compromise the security of the Platform

You may also close your account at any time by emailing support@pivchart.com.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of India, including but not limited to:

• Information Technology Act, 2000 and Rules thereunder
• Digital Personal Data Protection Act, 2023
• SEBI Act, 1992 and Regulations thereunder
• Indian Contract Act, 1872
• Consumer Protection Act, 2019

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India. You waive any objection to such jurisdiction.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and PivChart with respect to your use of the Platform and supersede all prior agreements and understandings.
